Overview

Estate planning is the process of making arrangements to pass down wealth and assets after a person’s death. Proper estate planning gives careful consideration to the estate owner’s future plans, preferences and goals. The tax implications of the plan should also be thoroughly considered.
Tax, Trust, and Estate Planning Overview
Estate planning is a strategy designed to protect, manage, and distribute your assets during and after your lifetime, while helping to minimize taxation. An estate plan will help protect your legacy and those you care about most.

    Trusts
An alternative to a will, a trust can be established. A trust involves three key parties: the Grantor (the person who funds the trust ), the trustee (the person who controls the trust and is the legal owner of the assets held in the trust), and one or more beneficiaries (for whose benefit the trust is established and who are the beneficial owners of the trust assets). Trusts include the following categories:

    Living Trusts
    Testamentary Trust
    Revocable Trusts
    Irrevocable Trust
    Funded Trust
    Unfunded Trust
    Trustee Responsibilities
A trustee is responsible for a number of tasks, most of which are simple, and some of which are complex. These tasks must be performed with the highest level of integrity. The trustee must also take into account the best interest of the beneficiaries.

    Gift and Estate Tax Overview
Each person is entitled to transfer via gift or bequest a certain amount of assets free of federal gift or estate tax. This exemption is $12.06 million in 2022. Note that the gift and estate tax law changes made by the 2017 legislation will sunset on January 1, 2026 so that the base exemption will revert to $5 million (adjusted for inflation from 2010) if there are no further changes in the law.

8Investors should consider many factors before deciding which 529 plan is appropriate. Some of these factors include: the Plan’s investment options and the historical investment performance of these options, the Plan’s flexibility and features, the reputation and expertise of the Plan’s investment manager, Plan contribution limits and the federal and state tax benefits associated with an investment in the Plan. Some states, for example, offer favorable tax treatment and other benefits to their residents only if they invest in the state’s own Qualified Tuition Program. Investors should determine their home state’s tax treatment of 529 plans when considering whether to choose an in-state or out-of-state plan. Investors should consult with their tax or legal advisor before investing in any 529 Plan or contact their state tax division for more information. Morgan Stanley Smith Barney LLC does not provide tax and/or legal advice.
